38ph Terms & Conditions

1 Acceptance of Terms

These Terms & Conditions govern your access to and use of the 38ph website, mobile platform, games, and all related services (collectively, the "Platform"). By creating an account, making a deposit, or placing a bet on the 38ph Platform, you unconditionally accept these Terms and agree to comply with them at all times.

If you do not agree with any part of these Terms, you must immediately cease using the 38ph Platform and close your account. Continued use of the Platform following any amendments to these Terms constitutes your acceptance of the revised Terms.

These Terms should be read in conjunction with the 38ph Privacy Policy and Responsible Gaming Policy, both of which are incorporated herein by reference and form part of the overall agreement between you and 38ph.

2 Eligibility

To be eligible to register and use the 38ph Platform, you must satisfy all of the following conditions:

• You are at least 21 years of age at the time of registration and at all times during your use of the Platform.
• You are a resident of or physically located in the Philippines at the time of accessing the Platform.
• You are accessing the Platform for personal, non-commercial entertainment purposes only.
• You are not a current employee, contractor, director, officer, or agent of 38ph, nor an immediate family member of any such person.
• You are not subject to any self-exclusion order, whether imposed by 38ph or any other gaming operator or regulatory authority.
• You are legally capable of entering into a binding contract under Philippine law.
• You are not accessing the Platform from a jurisdiction where online gambling is prohibited by applicable law.

38ph reserves the right to request documentary proof of age and identity at any time. Failure to provide satisfactory verification documents may result in the suspension or permanent closure of your account and the withholding of any pending withdrawals pending investigation.

3 Account Registration

To access the full range of 38ph services, you must register a player account. The following rules apply to all 38ph accounts:

• One Account Per Person: Each individual may hold only one active account on the 38ph Platform. The creation of multiple accounts by the same individual is strictly prohibited and may result in the permanent suspension of all associated accounts.
• Accurate Information: You must provide accurate, complete, and current information during registration, including your full legal name, date of birth, residential address, and contact details. Providing false or misleading information is a material breach of these Terms.
• Account Security: You are solely responsible for maintaining the confidentiality of your 38ph login credentials, including your username and password. You must not share your account credentials with any third party. 38ph will not be liable for any losses resulting from unauthorised access to your account caused by your failure to maintain adequate security.
• KYC Verification: 38ph is required to conduct Know Your Customer (KYC) verification on all accounts. You agree to provide any documentation requested by 38ph for this purpose, including but not limited to a government-issued photo ID, proof of address, and proof of payment method ownership.
• Account Closure: You may request the closure of your 38ph account at any time by contacting our support team. 38ph reserves the right to close or suspend any account at its sole discretion, including where a breach of these Terms is suspected.

4 Deposits & Withdrawals

38ph supports a range of payment methods commonly used by Filipino players, including GCash, PayMaya, BPI, BDO, and Met robank. The following conditions apply to all financial transactions on the 38ph Platform:

• Minimum Deposit: The minimum deposit amount on 38ph is ₱100. Deposits below this threshold will not be processed.
• Deposit Processing: Deposits made via GCash and PayMaya are credited to your 38ph account instantly. Bank transfer deposits may take up to one (1) business day to reflect in your account balance.
• Withdrawal Eligibility: Withdrawals are only permitted to payment methods that have been verified as belonging to the account holder. 38ph does not process withdrawals to third-party accounts under any circumstances.
• Withdrawal Processing: 38ph aims to process all withdrawal requests within five (5) minutes for GCash and PayMaya. Bank transfer withdrawals may take up to three (3) business days. Processing times may be extended where additional verification is required.
• Wagering Requirement: Deposited funds must be wagered at least once before a withdrawal request will be accepted. This requirement exists to prevent money laundering and financial abuse of the Platform.
• Currency: All transactions on the 38ph Platform are conducted in Philippine Peso (PHP / ₱). 38ph is not responsible for any currency conversion fees charged by your payment provider.
• Transaction Limits: 38ph reserves the right to impose minimum and maximum deposit and withdrawal limits at its discretion. Current limits are displayed in the cashier section of your account.

38ph reserves the right to delay or refuse any withdrawal where fraud, money laundering, or a breach of these Terms is suspected. In such cases, 38ph may request additional documentation before releasing funds.

5 Bonuses & Promotions

38ph offers various bonuses and promotional offers to eligible players from time to time. All bonuses are subject to the following general conditions, as well as any specific terms communicated at the time the bonus is offered:

• Bonuses are available to eligible registered players only. 38ph reserves the right to determine eligibility at its sole discretion.
• All bonuses are subject to wagering requirements. The applicable wagering requirement will be clearly stated in the specific bonus terms. Bonus funds and any winnings derived from bonus funds cannot be withdrawn until the wagering requirement has been fully satisfied.
• Bonuses may only be used for the games and game categories specified in the applicable bonus terms. Using bonus funds on excluded games will not contribute to the wagering requirement.
• 38ph reserves the right to withdraw, modify, or cancel any bonus offer at any time without prior notice.
• Any attempt to abuse, exploit, or manipulate bonus offers — including but not limited to creating multiple accounts, using prohibited betting patterns, or colluding with other players — will result in the immediate forfeiture of all bonus funds and associated winnings, and may result in permanent account suspension.
• Bonuses cannot be transferred between accounts or exchanged for cash except where the applicable wagering requirement has been met.

6 Game Rules & Fair Play

All games available on the 38ph Platform are governed by individual game rules, which are accessible within each game. In the event of any conflict between these Terms and the specific game rules, the specific game rules shall prevail in respect of that game.

• RNG Certification: All 38ph casino games utilise a certified Random Number Generator (RNG) to ensure fair and unpredictable outcomes. Our RNG systems are independently audited on a regular basis.
• Malfunction Policy: In the event of a game malfunction, disconnection, or technical error, 38ph reserves the right to void affected bets and return stakes to the player's account. 38ph's decision in such matters is final.
• Bet Acceptance: 38ph reserves the right to refuse, limit, or void any bet at its sole discretion, including where a technical error has resulted in incorrect odds or game parameters being displayed.
• Disputed Results: If you believe a game result is incorrect, you must raise a dispute with 38ph customer support within seventy-two (72) hours of the relevant game round. Disputes raised after this period may not be investigated.

7 Prohibited Conduct

The following conduct is strictly prohibited on the 38ph Platform. Engaging in any prohibited conduct may result in immediate account suspension, forfeiture of balances, and referral to relevant law enforcement authorities:

• Registering more than one account on the 38ph Platform.
• Providing false, inaccurate, or misleading information during registration or at any other time.
• Using the Platform if you are under 21 years of age.
• Using automated software, bots, scripts, or any other artificial means to interact with the Platform.
• Exploiting software bugs, errors, or vulnerabilities in any game or Platform feature.
• Engaging in any form of collusion, chip dumping, or coordinated play designed to gain an unfair advantage.
• Using the Platform for any money laundering, fraud, or other illegal financial activity.
• Attempting to reverse-engineer, decompile, or otherwise tamper with any part of the 38ph Platform.
• Harassing, threatening, or abusing 38ph staff or other players through any communication channel.
• Accessing the Platform using a VPN, proxy, or other means to disguise your true location.

8 Responsible Gaming

38ph is committed to promoting responsible gaming among all Filipino players. We provide a range of tools to help players manage their gambling activity, including deposit limits, loss limits, session time reminders, and self-exclusion options.

9 Intellectual Property

All content on the 38ph Platform, including but not limited to software, games, graphics, logos, trademarks, text, and audiovisual materials, is the exclusive property of 38ph or its licensors and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for personal, non-commercial entertainment purposes only. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from the 38ph Platform without the prior written consent of 38ph.

10 Limitation of Liability

To the maximum extent permitted by applicable Philippine law, 38ph shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Platform, including but not limited to loss of profits, loss of data, or loss of goodwill.

38ph's total aggregate liability to you for any claim arising out of or in connection with these Terms or your use of the Platform shall not exceed the total amount deposited by you into your 38ph account in the thirty (30) days immediately preceding the event giving rise to the claim.

38ph does not warrant that the Platform will be available at all times, free from errors, or free from viruses or other harmful components. We will use reasonable endeavours to maintain Platform availability but cannot guarantee uninterrupted access.

11 Privacy & Data

38ph collects, processes, and stores your personal data in accordance with our Privacy Policy, which is incorporated into these Terms by reference. By using the 38ph Platform, you consent to the collection and processing of your personal data as described in the Privacy Policy.

38ph implements industry-standard security measures, including 256-bit SSL encryption, to protect your personal and financial data. However, no method of electronic transmission or storage is completely secure, and 38ph cannot guarantee absolute data security.

12 Amendments

38ph reserves the right to amend, update, or replace these Terms at any time. Where material changes are made, 38ph will provide reasonable notice to registered players via email or a prominent notice on the Platform. Your continued use of the Platform following the effective date of any amended Terms constitutes your acceptance of the revised Terms.

It is your responsibility to review these Terms periodically to ensure you are aware of any changes. The date of the most recent revision is displayed at the top of this page.

13 Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any dispute arising out of or in connection with these Terms that cannot be resolved through 38ph's internal dispute resolution process shall be subject to the exclusive jurisdiction of the competent courts of the Philippines.

38ph operates under the regulatory oversight of the Philippine Amusement and Gaming Corporation (PAGCOR). Players who are unable to resolve a dispute directly with 38ph may escalate the matter to PAGCOR through its official channels.
